Metallic red paint, flaked off under car wash wand? Warranty or no?

We recently bought a used '16 ragtop, carfax says previous fleet. Anyway, My wife calls me from the coin carwash saying I won't believe this, and to come over. I arrive and she shows me a spot where the paint came off under medium, not high, pressure. Underneath, I can't tell if I'm seeing filler or what. At any rate, we're wondering if anyone else can tell us: would this be a warranty issue since the car is just year old. my prior '96 Miata and '06 Miata had no issues with this same carwash over the last two years. How would you approach correcting the problem, based on my photos? At bottom left looks like there's one more flap of paint ready to bubble off if the wind hits it just right. What's a bit troubling also is that this was an extra-cost color for 2016, so I hope that doesn't go against me in trying to get the dealer to warranty or goodwill the repair. Your advice?

AggieRed2016 - I'm no professional when it comes to paint... but I HAVE seen this before and it was due to improper prep before applying the paint. I do NOT believe that's the factory paint flaking off. I think the car was probably damaged as a rental and they repaired before being resold to the public. Carfax is not always 100% accurate. There are a LOT of repairs that happen out there which are never reported to carfax. You can take it to a Ford dealer since it's under warranty and let them diagnose whether that's actual factory paint peeling off, or just a shoddy repair. If they determine this is not factory paint chipping off then you'll need to go back to where you purchased the car and take it up with them. If it is the factory paint peeling off (shame on you Ford) then it should be covered under warranty if the car is under 1 year old and has less than 12,000 miles.

P.S. I just looked at your pictures really close and it sure looks like that rear fender was damaged and repaired. If you look at the wheel well arch you can see the body line is not sharp and pronounced. Plus it definitely looks like "filler" at the very top portion of where the paint peeled.

It's a used 2016, but has 33K on the odo, so paint warranty is over. Bought it from a Ford dealer, who I believe had only had it on the lot for 4 days before making it an Internet special. We're calling the Ford dealer we bought it from, starting with "Carfax showed no accidents" plus they "hid" a special Paint protectant in the sale that I paid $200 for. So I shouldnt have flaking paint within a month of purchase.

Go get 'em and make them pay to have it properly painted/repaired at an auto body shop of YOUR CHOOSING!

You were the wind beneath our wings. My wife went in to pick up our license plates, and pointed it out to the pre-owned sales manager. He agreed to repair it at no charge, and provided a loaner for the week-long repair.

Got the car back today, and the repair is invisible to us. Looks great, and hopefully in three months we'll have forgotten the whole episode.
